2010 Rates & Waiver
2010 Guided Pack Trip Rates
June
through September 2010 - *rates are for 2 or more people*.
$225/day/adult
$200/day/child age 8-14
A
50% deposit is required to hold your reservation, and is
non-refundable. The balance of payment for your trip is due no
later than 15 days before the start of the trip.
Please contact us as soon as possible to reserve your dates and
customize your summer vacation.

Reservations with deposit received before April 30th will be
entitled to a reduced rate of $200 per day per person.
WAIVER, ASSUMPTION OF RISK & INDEMNITY AGREEMENT
Please read carefully, then print a copy, sign and
return to us with your deposit.

WARNING:
By signed this agreement, you give up the right to sue for any
injury or damages howsoever caused.
To
Packing In Paradise (hereinafter referred to collectively as
“The Company”) and employees, representatives, officers and
agents (hereinafter referred to collectively as “The Company
Employees”).

1. I agree, the
person who signs this agreement represents that she/he is authorized
to enter into this agreement. In consideration of acceptance of a
single reservation for a pack trip with “The Company”.
2. I agree as a
precondition to my participation in any activities organized by “The
Company” and conducted by “The Company” and/or “The Company
Employees”, and in further consideration of “The Company” allowing
me to do so, to be strictly bound by the terms of this Waiver,
Assumption of Risk & Indemnity Agreement (hereinafter referred to as
“This Agreement).
3. I hereby release
“The Company” and will defend “The Company” and hold it harmless
from any claim, present and future, for any and all loss by
disappearance or theft, any injury, damage, claims, demands and
liabilities involving, but not limited to, any aspect of any pack
trip taken by the aforementioned client/participant. I further
agree to hold the aforementioned parties harmless of anything
alleged to be caused by the negligence of the parties
aforementioned, or by the negligence of any other person, or any
other cause or causes. I hereby assume the sole responsibility for
and agree to indemnify and save the aforementioned parties harmless
from any and all loss and expense (including legal fees) by reason
of the liability imposed by law upon any of the aforementioned
parties for damage because of bodily injuries, including death
resulting at any time therefore sustained by any person or persons,
including myself, or on account of damage to property arising out of
or in consequence of my participation in this event, howsoever such
injuries, death, or damage to property may be caused, and whether or
not the same may have been caused or may have been alleged to have
been caused by negligence of the aforementioned parties or any of
their employees or agents or any other persons.
4. I acknowledge that
horses, trail rides, pack trips and related activities involve
inherent risks that may cause serious injury and possibly death to
participants. I further recognize that back country trails, horses
and wagon rides may involve additional risks and dangers. I fully
understand the risks and dangers associated with my participation in
this/these activity/activities and accept the same entirely at my
own risk.
5. I hereby waive any
and all claims which I may have against “The Company” and/or “The
Company Employees” and release “The Company” and/or “The Company
Employees” from any and all liability for injury, death, property
loss or damage or any other loss sustained by me as a result of my
participation in this activity, due to any cause whatsoever
including, without limitation, negligence on the part of “The
Company” and/or “The Company Employees”. I further agree to
indemnify “The Company” and/or “The Company Employees” for any and
all legal fees (on a solicitor and his own client basis) or costs
which may be incurred in defending any lawsuit or claim I may bring
against them.
6. I appreciate that
This Agreement applies whether “The Company” is at fault or not and
it limits the liability of “The Company Employees” to the same
extent as it limits the liability of “The Company” even though “The
Company Employees” are not formal parties to This Agreement. I
understand that “The Company”, in securing execution of This
Agreement by myself is acting as agent or trustee on behalf of or
for the benefit of “The Company Employees”, who shall to this extent
be or be deemed to be parties to This Agreement.
I have read and
understand This Agreement. I understand that this document contains
a promise not to sue “The Company” or “The Company Employees” and a
release and indemnity for all claims.

to uphold all covenants of This Agreement signed at (City)
